Terms of Use

These Terms of Use ("Terms") govern your use of the Cool Dive mobile application ("the Game") developed and published by HelioShred Games ("we", "us", "our"). By downloading, installing or using the Game, you agree to these Terms. If you do not agree, do not use the Game.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial purposes on devices you own or control, subject to these Terms and the rules of the platform from which you downloaded the Game (Apple App Store or Google Play Store).

2. Intellectual Property

The Game and all its content, including but not limited to the Cool Dive name and the Pino character, artwork, animations, music, sounds, text and code, are owned by us or our licensors and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell or lease any part of the Game, nor may you reverse-engineer or attempt to extract the source code.

3. In-App Purchase

The Game offers one optional in-app purchase. Purchases are processed by Apple or Google through their respective app stores and are non-refundable except as required by applicable law or the platform's refund policy.

Remove Ads (non-consumable): a one-time purchase that permanently removes all advertisements from the Game. It can be restored at no additional cost on any device signed in to the same Apple ID or Google account.

4. Advertising

The Game is free to play and displays ads provided by third-party ad networks, such as banners and occasional full-screen ads on the game-over screen. Ad content is not controlled by us. If you purchase Remove Ads, ads will no longer be displayed.

5. Leaderboards

If you are signed in to Game Center or Google Play Games, your best score and your nickname on that service are shown on the Game's public leaderboard. We may remove scores that appear to have been obtained by cheating, exploiting bugs or tampering with the Game.

6. Acceptable Use

You agree not to:

Use the Game for any unlawful purpose
Attempt to gain unauthorized access to the Game's systems or other players' data
Exploit bugs or vulnerabilities instead of reporting them
Use automated tools, bots, modified versions of the Game or scripts to play or to submit scores

7. Play Safely

The Game can be steered by tilting your device. Play in a safe place, keep a firm grip on your device and stay aware of your surroundings. Do not play while driving, cycling, walking in traffic or in any situation that needs your full attention.

8. Availability

We strive to keep the Game available but do not guarantee uninterrupted access. We may update, modify or discontinue the Game or any of its features at any time without prior notice. Leaderboards and ads require an internet connection.

9. Disclaimer of Warranties

The Game is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, use or profits, arising out of or related to your use of the Game, regardless of the theory of liability.

11. Privacy

Your use of the Game is also governed by our Privacy Policy, which describes what data the Game uses and how third-party services handle it. By using the Game, you acknowledge that you have read and understood the Privacy Policy.

12. Third-Party Services

The Game integrates with third-party services, including ad networks, Apple Game Center and Google Play Games. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Game after changes constitutes acceptance of the updated Terms. If we make material changes, we will notify you through the Game.

14. Termination

We may suspend or terminate your access to the Game at any time if you violate these Terms. Upon termination, your license to use the Game is revoked. Sections that by their nature should survive termination (including intellectual property, disclaimers and limitation of liability) will continue to apply.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal. If you are a consumer in the European Union, you also benefit from any mandatory provisions of the law of your country of residence.
